These Terms of Use ("Terms") are a legal agreement between you and Anton Dimitrov ("we", "us"), the developer of the Simple Flashy app ("the App"). By downloading, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your own personal, non-commercial use, in line with Apple's App Store Terms of Service. You may not copy, modify, reverse engineer, resell, sublicense, or distribute the App.
The App is sold for a single one time price through the App Store. There are no subscriptions, no in app purchases, and no recurring charges. All payments, refunds, and billing are handled by Apple under Apple's terms. We do not process payments and cannot issue refunds directly.
The Strobe mode produces rapidly flashing light. Flashing lights can trigger seizures, loss of awareness, or other serious effects in people with photosensitive epilepsy, even those with no prior history. If you or anyone nearby has a history of seizures or epilepsy, do not use the Strobe mode without medical advice. Stop using it immediately and consult a doctor if you experience dizziness, altered vision, twitching, disorientation, or convulsions. You use the Strobe mode entirely at your own risk.
The SOS mode is a convenience feature that flashes a light pattern. It is not a certified safety, signalling, or rescue device and is not a substitute for professional emergency equipment or emergency services. Never rely on the App, or on any phone, as your only means of signalling for help or preserving your safety. Battery level, device condition, weather, and visibility all affect whether a light is seen. In a real emergency, contact the official emergency services for your location. We accept no responsibility for any outcome arising from reliance on the SOS mode.
Do not shine the light directly into anyone's eyes, including your own, and do not use it in a way that could distract drivers, pilots, or others. You are solely responsible for using the App safely and lawfully.
To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, reliability, availability, or non-infringement. We do not warrant that the App will be uninterrupted, error free, or that it will function on every device or iOS version.
To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profit, health, property, or personal injury, arising out of or related to your use of, or inability to use, the App, even if we have been advised of the possibility of such damages. To the extent liability cannot be excluded, our total liability is limited to the amount you paid for the App.
You agree to indemnify and hold us harmless from any claim, loss, or expense, including reasonable legal fees, arising from your misuse of the App or your breach of these Terms.
The App, its design, code, name, and content are owned by Anton Dimitrov and are protected by intellectual property laws. These Terms grant you a license to use the App, not ownership of it.
This license ends automatically if you breach these Terms. On termination you must stop using the App and delete it.
These Terms are governed by the laws of the Republic of Bulgaria and, where applicable, the European Union, without regard to conflict of law rules. Nothing in these Terms limits any mandatory consumer rights you have under the law of your country of residence.
We may update these Terms from time to time. The current version is always posted on this page with the date above. Continued use of the App after a change means you accept the updated Terms.
